Following the direction of the Herndon Town Council, the Town of Herndon has launched an educational campaign designed to advise citizens and others as to the proper procedures for hiring day workers in the town.  The campaign informs those who employ day workers that 1) it is illegal to hire workers on private property, and 2) U.S. law prohibits hiring workers without an employment check/I-9 form.

Signs incorporating these messages are currently being erected in the vicinity of Elden and Alabama Streets.  I-9 forms will be available at these locations and at the Herndon Municipal Center, 777 Lynn St., and the Neighborhood Resource Center, 1086 Elden Street.

"The town's zoning ordinance prohibits the hiring of day workers on private property - and federal law prohibits the hiring of day workers without an employment check, or I-9 form," said Mayor Steve DeBenedittis.  "Our aim with this campaign is to educate employers of day workers to these requirements and to follow through with our own zoning enforcement activity and with direct contact to Immigration and Customs Enforcement if we note violations to these requirements."

An August 2007 ruling by Circuit Court Judge Leslie Alden maintains that the right of individual day workers to solicit for work on public streets is protected by the U.S. Constitution.  In addition to the zoning restrictions and federal I-9 requirement addressed through the educational campaign, day workers may not "unreasonably or unnecessarily" obstruct the public right-of-way.  In addition to the zoning restrictions prohibiting hiring of day workers on private property, individuals looking to hire day workers must be parked legally and may not impede traffic and/or the right-of-way on public streets.  The Herndon Police Department enforces all traffic laws in the Town of Herndon.
