Meals tax is a tax imposed on the purchase of all prepared and ready to eat food and beverages. It is collected in trust by all businesses in the Town of Herndon that sell prepared meals and must be remitted to the Town of Herndon on a monthly basis. The current Meals Tax rate, through June 30, 2019, is 2.50% and is collected in addition to the 4.5% Virginia State Tax, the 1% Fairfax County Local Tax and in Northern Virginia, an additional 0.6% state tax for transportation. For meals sold on and after July 1, 2019, the Meals Tax rate is 3.75%.
Meals Tax collection and paymentFood establishments must report and pay the amounts collected monthly to the Town of Herndon-Revenue Division. The Meals Tax Remittance Form and payment are due on the 20th of each month for the meal taxes collected during the preceding month.
Remittances received after the 20th of the month are not allowed the 6% On-Time remittance deduction and are subject to a penalty of 10% of the tax due or ten dollars, whichever is greater.
Payments received after the 30th of the month are assessed interest of 10% per annum.
